Hi everybody!
nice to meet you and thanks for any advice :)
I'd like to ask you a question since as I said before italian consulate is not that full of infos...i hope this is the correct section !
I filled up my DS156 online for a H4 ViSA Application two months ago, but then me and my husband who works in the U.S. have found out that we need an extra document, that will be issued much later. So we left it pending and never took an appointment at our consulate.
My question is: since the conditions and answers might be different next time, can I just erase my DS156 form and fill up a new one next time I need?
How can I erase it?
i'm going to visit him on christmas time to spend some time together, as tourist with VISA WAIVER... might I have problems enterning the us by custom service because i filled up this application time ago?
can I just say i'm going to visit my husband for that months being honest?

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. This means that the agency has received 700 more H-1B petitions than it can approve. Why then is the USCIS still accepting H-1B petitions? Because some of the petitions that...

Can people convert LC pending in BEC to PERM? If So, how safe it is and how much time it takes totally.
Yes, and its well known. Talk to or just visit Murthy or Immigrationportal and you will find lot of discussion on this topic. In a nutshell, as long the PERM application is identical to BEC pending application you can convert to PERM. Make sure to find an attorney familiar in such type of cases.

Like most of you, I have been following the case of Umar Farouk Abdulmutallab, the 23-year old Nigerian man who attempted to ignite a bomb on a flight from Amsterdam to Detroit. As facts begin to emerge, we can now start to discuss the immigration issues that arise in the case. There seem to be more questions than answers at this point and no doubt Department of Homeland Security and Department of State officials are reviewing how Mr. Abdulmutallab was able to fly to the United States. Here are some initial questions. 1.In May 2009, Abdulmutallab's UK visa was revoked...

Immigration and Customs Enforcement Assistant Secretary John Morton announced today that the agency will inspect the I-9 records of approximately 1000 companies around the US, dwarfing the announcement in July that nearly 600 firms were being investigated. Only 500 firms were audited in 2008. This time the employers being targeted are firms involved with "critical infrastructure" projects. ICE also released some interesting data showing the impact of its new enforcement initiatives: Statistics since implementation of new ICE worksite enforcement strategy on April 30: 45 businesses and 47 individuals debarred; 0 businesses and 1 individual were debarred during same period in...

It all depends if your I-140 has been filed and approved and the I-485 has been pending for 6 months+.
If your I-140 has been approved and six months have passed since the filing of the I-485 then you should have no problem working in the same/similar job capacity under AC21 provisions.
Having said that, I don't know what the USCIS would do nowadays given the really bad economy.
This is not a professional advice and you should consult a lawyer on your specific case.

Hello, my wife and I have been approved and got notice of action (I-797C) in mail May 23 (recieved date May 22). Online USCIS states our cards went into production June 13th and allow 30 days to recieve. We have not moved but will in mid August in order to begin work under OPT. We called USCIS service center on 1-800-375-5283 on 30th day and put in a trace on our cards. USCIS states case will be assigned within 30 days and then expect within 45 days to hear. This is impossible as we hope to begin work before that. I know that calls can be made to get permission to work as we are F-1 graduating Aug 8th BUT need the cards for our bank to approve financing.
Question - is there any way to make direct contact with someone who can tell us the card WAS mailed and provide confirmation. It is odd that regulkar mail delivers such a valuable, time consuming document.
Any comments would be helpful.

I have an approved labor and I-140 (EB2) with a PD of Aug 03, since USCIS guideline says that the demand for EB2 India seems to exceed the supply of GCs, I am not sure how much longer it will take for my PD to be current.
My company has a approved labor (EB2) with PD of 2002 (with job requirements matching my qualifications). I have the following questions:
1. Can I apply for premium processing for the I-140 stage with the substituted labor?
2. If not, does it take longer to process I-140 with substituted labor than the normal case?
3. if I can get the labor with 2002 PD, can my company give my labor to someone else (especially since my I-140 is already approved with that labor)
Thanks in advance.
