Universal health care does not just mean that every American has health insurance. It also means that they have access to doctors and nurses. And right now there are dire shortages in both fields. I've posted articles here on the nurse shortage (and you can see a lot more of my writing on this subject at my health care immigration blog at http://www.visalaw.com/blog_hc/blog_hc.html). Today's front page of the New York Times has a story describing the White House's worry that the physician shortage (which could reach more than 150,000 by the end of the next decade) could hamper efforts to...

Left-wing reporter Greg Palast argues that the new Arizona law has nothing to do with stopping illegal immigration and everything to do with targeting the Hispanic US citizens in the state - nearly 30% of Arizonans - who vote overwhelmingly Democrat. Palast lays out the case that the state's GOP has been engaged in a long war on these citizens that involves uppressing their votes and driving them from the state.

I recently got my EAD card. I intent to continue to work full time with my current employer. I want to work part time with another employer. My H1 is stamped and valid untill end of 2008.
If I use my EAD card for part-time job, does my H1 get invalid?
If yes, do I need to inform my fulltime employer about change in status?
If no, can I travel outside USA with the H1 visa for reentry?
Please help.

If a consultant moves from their primary work location to a client site in the same city (literally a few blocks down the street), is a new LCA or amendment required?
Do most people who work on project basis for different clients (and not fulltime for a particular employer) file a new LCA/amendment everytime they get a new project?

Something new I'm starting. USCIS puts out weekly data on the use of H-1B visas for the 2011 fiscal year which starts in October. I'm going to monitor that for readers and add my own projection on the months the caps are likely to be hit. The quota is 65,000 per fiscal year plus an additional 20,000 for folks with degrees from US advanced degree programs. Applications began being accepted on April 1st. In past years, the H-1B quota was exhausted almost immediately after the application period opened up. Last year, as a result of the recession and also as...

I requested for a document that got returned as undeliverable to be resent.
I first requested CSR and she gave me a referrral#.
Same day I spoke with IIO and she made the request again for me(before I could tell her I spoke with CSR)
Today I spoke with a CSR and gave her the referral# that the CSR gave me last week and this lady says she didn't find any information related to this referral# .She did say it does surprise her. She also said she will open a new request .
I was concerned if that will be kind of duplication of the work done by CSR & IIO last week and she said there is no need for such concern.
What does all this mean?
They open a request , give you a referral# and tell you the document will get mailed in 3-5 business days .
IIO says she has placed a request.
You go back after a week , and referral# has no information attached to it and this CSR says she 'll open new request.
Anybody has any idea?

max, the problem is there is no clear cut definition of how an IO is supposed to respond to the scenarios you mentioned.
but i suggest that you search IV archives as this subject has been discussed in-depth before. i remember 1 or 2 ppl posting their AC21 and subsequent GC approval experience via self-employment/ LLC registration.
good luck. pls let us know ur future experience in this matter.

Can the primary applicant travel on AP while an MTR is filed to appeal the denial for the dependent? NOD was issued as a result of CIS erroneously stating that the non-immigrant status of the dependent lapsed for over 180 days.

The folks at the Immigrant Legal Resource Center have come up with a list of recommendations for legislators as they craft a legalization plan in the upcoming comprehensive immigration reform debate: 1. Date of entry requirement for eligibility: The required date of entry should be as close to the date of introduction of the bills as possible. This will accomplish the goal of legalizing as many otherwise deserving immigrants as possible as well as simplifying the administration of the program by CIS. [Simple and Broad Eligibility Provisions] 2. No known to the government requirement: The legalization program should not include...

prevailing wage calculations for EB-2 applications to be filed for Sr. Systems Analyst and Sr. Software Engineer. As of January 1, 2010, these wage requests have to be filed using US DOLs electronic iCert system. For the past couple of years, the NJ DOL had given us LEVEL II wages for these positions. Now, US DOL is giving us LEVEL III wages for these positions which is at $102,274
EB-2 Software Engineer/Systems Analyst LEVEL III at $102,274 , or file under EB-2 ITPM LEVEL II at $116,501
I wanted to confirm whether these wage Calculations Declared by DOL are correct to file for EB2 category and do we need to quote such high salary ranges.I have master's degree plus 5+years of Experience in IT field. So, i will qualify for EB2 category but only wanted to confirm whether the wages declared by DOL were correct in respect to Jan 2010
Anyone or the concerned attorney can you please clarify on this.
Thanks

Hi,
I was working for Company A with whom I've my H1 & I-94 valid until Aug 2010. But I was laid off from Company A in Dec 1st week and I found a new job with Company B in Jan 3rd week. So I was out of status for about 6 weeks time.
Now Company B don't wish to file a transfer but instead they are filing something called H1 "Loose Petition", obviously I'm not going to start work with Company B until this H1 gets approved and I travel out of US, get restamped based on my New H1 petition, come back to US and start work for Company B.
But my question is, while from today until this so called "Loose Petition" H1 is getting processed (since they applied premium it would take about 2-3 weeks) can I legally stay in US (in terms of I-94 I've my I-94 from Company A H1 which is valid until Aug 2010)?
My employer suggest that I stay here until H1 processing result comes out and then leave country get restamped. Please let me know if you have an Answer.

Sorry for the cross posting.
My papers were sent on June 21st, but they were receipted only on June 27th. Turns out USCIS returned my $1000 for premium processing :(.
My lawyer said they talked to USCIS and USCIS asked them to re-file with proof of receipt.
Did anyone who filed in end June have their 140 premium processing returned?
