My I 140 was transferred from NSC to washington DC office on July 27, 2007. Since then, Online case status does not say anything more than this. I am in my 7th year and worried. Does anyone has any idea as to why I 140 cases are transferred to local offices. Do local offices have authority to decide on I 140 cases? How long would it take for the local office to send a decision on it? How do I ollow up with the case? Attorneys / gurus please help..

Now that USCIS has dropped bomb by announcing the revised bulletin, do you think now they will be able to bring back the premium processing for I-140? or still they dont have time to "ensure" processing in 15 days.

I didn't have any problem at Port of Entry. The immigration officer scanned the visa, but I guess he didn't find anything linking to the fact that the previous company has canceled the H1.

An employer did H1 processing for Ms.A on US Masters degree quota in 2007, but she decided to go back to school before the H1 kicked in (communicated the same with H1 sponsor/Employer) and is getting the degree (PhD Engg) in Aug 2010. Ms. A never worked on H1 and continued to be a full time student(made the mistake of telling the university about H1).
FYI: Ms. A traveled to home country and got back on F1 visa in Aug 2007
What solutions does she have now?
1. Get a job, continue on H1 and extend it?
2. Get back to F1 ( graduate in December instead of Aug. Really difficult to find other schools giving I 20 now!)
(Ms.A may have to visit home country this year for personal reasons and visa stamping is required to get back to US!!!)
Is there any other solution?
Do you think consulting two different lawyers is helpful in this situation?
How much may be the Attorney fee ?
Deeply appreciate your input.

Hi,
I got my labor approved couple of weeks back and now attorney is filing I-140. My situation is
Job 1 : Worked from July 1st 2006 to Oct 2nd 2007 (Laid off on that date and h1b was not cancelled ever after)
so applied for h1 transfer immediately, USCIS received application on Oct 9th 2007 (Regular processing)
While I was waiting on that, I got another fulltime job in Nov, Applied for h1 through this company (Premium processing) and got approval within a week, started working from Nov 15th 2007 to till date..
In Decemeber 2007, I got approval for pending H1b from 2nd compnay too.. but never used as i was already working for Company 3.
So, In my labor requirement it was M.S. and 1 yr relevant experience, Labor approval showing employemnt history as
Job 1 : July 1 2006 to Oct 2 2007
Current Job : Nov 15th 2007 to till date
Is it a problem if it shows 1 month gap between these two jobs?

Hi - I am just wondering, if Medical residency applications are subject to the yearly 65,000 Quota? Does anyone know?
If the hospital (healthcare organization) is a non-profit body then they will not be subjected to the quota (I think). Maybe other members can validate this.

I am working for a MNC and I got L1 visa stamped. After marriage I got my H4 visa stamped.(After L1 stamping) But the Visa officials have not marked the L1 visa cancelled in the passport, does it mean that the Visa is still valid? Does that mean that i can still travel on my L1 visa?
If your L1 petition is still valid (not withdrawn by employer) and you intend to work for that employer (ie. fullfill all other L1 requirements) then yes, you can still travel on L1 and maintain L1 status in the US.

During my last H1 transfer in 2008,LCA was filed for 60k per anum.LCA was filed in as work location Lanham,MD
Last Year ,my payroll ran for 90k per annum.
This year , my pay stub is running for 60k per annum. Still my Labor is for 60k only.
Will this be a problem when I am applying for Labor and at I140 stage in GC process?
Now If I am applying for H1b Extension,because of this drastic difference of 30k per anum,
will this be a problem.

I have been on q job with a client since October. The setup is like this. Me->my employer->Vendor-.Client.
The work order my employer has states that my work with the client ends June end, with a possibility of extension. if i file my h1b now, will i be a good candidate for rejection , considering that I do not have a long term project? Also, how true is it that the USCIS is giving visas out only for 1 year under such circumstances, as opposed to the regular 3 years term, and if true, how do I avoid it
Lastly, what is your take on how H1 filings on Apr 1 2010 will be? Is it expected to the same as last year, or will companies file left right and center on day 1 itself?

Well seems like today both sides are going to blame each other for not having a bill today. Big question is - does discussions/negotiations re-start after the recess or is this issue pretty much dead. Most probably they will announce that they will re-start the discussion after vacation and provide the "most important legislation"...blabla... But what are the chances really? especially with new scandals beginning to take all the headlines. This is really frustrating and unfortunate. Lets see how the day goes.

My I-485 case has been transferred from Texas center to Nebraska and notice says it's for faster processing. My priority date is Nov 2003, EB3 category, indian national. I didn't expect they would be looking at my case now. Why would they transfer it? has anyone received any such notice?
