Hi,
I am currently on F1 Status
I have a Vaid H1 Visa which was issued by my previous employer on 2006.But I did not use the VISA as I entered US as a student and have never worked in the US on H1.
the new employer is willing to sponser my h1. As I was already counted in the cap once within past 6 years, I need not wait till april to process my application.
is this correct?
If one is in some other status other than H1 currently, They don't need old paystubs for the transfer.I need a copy of the I797 or the receipt number of my old H1 for transfer.
I can provide the receipt number which is available on my visa. My previous employer is not willing to give me a copy of I797.
what are the chances that my application being approved without old I797 but just the receipt no for proof of me counted already once

On the left, the hope was that Pelosi would lead the newly empowered Democrats to hijack President Bush�s agenda on the issue that matters most to party activists � ending the Iraq war.
To Pelosi�s regret, that has not happened either.
Appraisals of Pelosi�s first year revolve around these fallen hopes and come with still another surprise: For all her history-making status as the first woman to run the House, Pelosi has emerged as a fairly conventional leader.
This is partly to her credit.
She has run a highly disciplined operation, keeping a potentially fractious caucus unified on tough issues.
And she has restrained some of her own instincts representing one of the nation�s most liberal districts.
With a couple of prominent exceptions, she has not handed Republicans opportunities to exploit impolitic statements or legislative maneuvers.
But conventionality has come at a steep cost.
Few members of either party, when speaking privately, argue that what Congress needs most is a change of party with a continuation of the highly partisan status quo.
In many ways, that�s what Pelosi represents.
Democrats bridled at being marginalized under 12 years of Republican rule, but Pelosi has treated turnabout as fair play.
Bending a promise made to voters in the last election, the speaker has shut Republicans out of many debates by limiting their ability to offer alternative ideas on the House floor and made only modest attempts to engage Republicans on many issues, notably Iraq.

�Maybe we should have been thinking about how we were communicating with the public more,� she said. �Maybe I should have from the start just established what we were doing instead of having to be responsive to the press about �somebody said this, they thought you were doing that,� because this place is a total rumor mill.�
Even so, Pelosi made clear that she is fine with drawing sharp, partisan lines when necessary.
�I certainly want my speakership to be distinguished by a level of civility and bipartisanship when that�s possible,� she said. �That is what I hope to do in this next year, I really do.�
But as for this year? �I had a job to get done this year,� she said. �I had a decision to make; I had to remove obstacles to getting a job done.�
She got it done, at times.
Early in the session, Democrats moved their �six for �06� package promised in the previous election. That included raising the minimum wage, enacting homeland security upgrades and reducing student loan rates.
They also helped their members by pushing for more spending on children�s health care, a political no-brainer for many members, and demanding that Congress offset the cost of new spending with spending cuts or revenue increases elsewhere.
Along the way, the elegantly styled speaker, a grandmother of seven, proved herself a steel magnolia � a self-confident leader who projected strength in a way that caused powerful subordinates to defer to her.
Even Vice President Cheney complimented (in a distinctly backhanded way) her leadership, noting he was surprised that such old Democratic bulls of the House as Reps. John P. Murtha of Pennsylvania and John Dingell of Michigan seem to follow her lead.
�They are not carrying the big sticks I would have expected,� Cheney told Politico.
�There�s a woman who runs that place with an iron hand,� Senate Majority Leader Harry Reid told Politico in an interview. �I am sure that some people are a little disappointed [that] this diminutive, very attractive woman is bowling people over � men and women.�
Pelosi has succeeded in part by having her own team of old bulls, such as Rep. George Miller of California, and younger bulls, such as Rep. Rahm Emanuel of Illinois, on her team.
What is sometimes called a weakness � a penchant for micromanaging, for instance � has helped tighten her grip and enhance her standing.
She has muffed up on a few high-profile occasions. A trip to Syria earlier this year was ridiculed by Republicans as clumsy, freelance diplomacy.
She was forced by her Democratic colleagues to quit pushing for the Armenian genocide resolution because it was clearly complicating U.S. relations with Turkey.
The final verdict on her handling of the Iraq debate awaits the year ahead � whether Democrats can either force a change in policy or make Republicans pay a heavy price in the 2008 elections.
For now, the best grade Pelosi can get is incomplete: Democrats have had no substantive success in changing policy.
One what-if echoes. Some members say Democrats missed a golden opportunity early in the summer to find compromise and split Republicans from Bush, laying the groundwork for limits on the military operation.
Pelosi instead pursued an unyielding approach that turned off even the war skeptics inside the GOP.
In a sign of the pressures Pelosi is under, however, it is the anti-war liberals in her own party who offer the harshest assessment of the Pelosi reign so far.

California Rep. Lynn Woolsey added: �I personally don�t think [the strategy] worked. As a result, everything we�ve done on student loans, minimum wage, the six in �06 agenda gets lost.�

Through AILA inquiry, I came to know my case details:
CIS electronic records indicate that your case have moved from the
security review area to the Case Resolution Unit(CRU). Will check
with supervisors of the CRU to find out what is going on with these cases
and if they can be routed to exams to be worked".
What does it mean ? What is happening in CRU ?
Internet refers CRU handles if case has multiple "A" nos or receipt notice delays....I filed only one I-485 application five years back.....

The USCIS announced today, April 27, 2009, that it has received approxiamtely 45,000 H-1B petitions counting toward this fiscal year's general cap of 65,000. Therefore it will continue to accept H-1B petitions that are subject to the general cap.
Then USCIS also announced that it has received approximately 20,000 H-1B petitions for aliens with U.S. advanced degrees subject to the 20,000 advanced degree cap. However, the USCIS says it will continue to accept additional advanced degree petitions because it knows from past experience that some number of the advance degree petitions are not approvable for any number of possible reasons.
I will update this blog on the H-1B account as soon as the USCIS makes further announcements.

I have been on q job with a client since October. The setup is like this. Me->my employer->Vendor-.Client.
The work order my employer has states that my work with the client ends June end, with a possibility of extension. if i file my h1b now, will i be a good candidate for rejection , considering that I do not have a long term project? Also, how true is it that the USCIS is giving visas out only for 1 year under such circumstances, as opposed to the regular 3 years term, and if true, how do I avoid it
Lastly, what is your take on how H1 filings on Apr 1 2010 will be? Is it expected to the same as last year, or will companies file left right and center on day 1 itself?

I sent the applications(I-140,I-485,I-131,I-765)to Nebraska center 4 weeks ago and it was received by them the next day(because I tracked the FedEx package).Until today,no receipts yet and my checks are not cashed yet and the receipting update says Current for Nebraska, is the normal or there is something wrong?

You can initiate the process for both of you individually. Means u can apply Labor, I-140 individually. After that while applying I-485 its advaisable to move with the lawyer suggestion. So till I-140 you both can apply individually.

I hope someone can help me out here. Here's my situation -- I am EB2 with PD of May 24th 2006 (current date is May 8th 2006).
I applied for my I-485 September 2008 and have had EAD for more than a year now. However, I got married in Feb 2009 (after my 485 application) and never had a chance to add my wife to the application (she's on H4).
Now, I really really want to change my job (not change of role/title, just change of company).
How does it work if I change companies now? I don't want to or rather can't use EAD since that will make my wife's status invalid. Now, if I am to get a H1B transfer, what happens with my GC application given I already have my EAD with the current company??
Please advise. Thank you!

I got Duplicate I485, I765, I131 receipts. All the receipts has same A#. One set of I765 & I131 approved. For the second set , they send REF about Photos as I have not submitted any supporting documents ( Photos, I94 etc) for second set. I have submitted the second set as follow up since I didnt get receipts for the first set within 5 months.
Now I want to withdraw duplicate I485 set. Any problems ?

I went for Fingerprinting for I-485 case seond time on 9th May. When it is updated in your profile at uscis website. I see it is still showing up old dates as LUD.
Any idea ?

My H1B was refused under section 221(g) (petitioner is not able or willing to provide employment....) and case has reached USCIS for review. The lawyers however are asking me to travel on H4 and then convert to H1 in US and they say this can be done in 2 weeks. I am so very skeptical about this! How is this even possible?
Their response is that i have an H1B from earlier quota, so i can get a new petition filed and start working on it once its approved.How come people dont do this if its valid?
My questions if anybody can help me are
1) Can i go on H4 visa without revoking my H1B petition which is under review with USCIS? Or will consulate ask me to revoke my H1B petition?
2) If i go on H4, can i really get a COS to H1 in US i.e. not the April 2011 quota but in the already assigned quota and i can start working within a few days of approval?
