too tired to celebrate...but hopeful that something might yet happen that will do something with the retrogression. hubby is already complaining that he reached the top in his senior position and there is no more professional growth for him, so the ability to file I-485 (if it happenes) would be a golden one for both of us... he would not feel so chained by his employer and I will finally say goodbuy to this wretched H4 status.
Will see where things move in the near future and hope for the best..

Sorry eastindia but you are plain wrong. The US is not East India Company.
Here are the facts about the US checks and balances:
1. No single entity - not the President, Senate, House of Representatives, state Governors, nor anyone else - has the power to overturn a US Supreme Court ruling. Supreme Court decisions cannot be nullified by other parts of government.
2. If the Supreme Court strikes down a federal law, Congress can always modify the law until it is such that the Supreme Court does not consider it to violate the U.S. Constitution. Then they would have to vote to pass the new law, and the President would sign it.
3. The Supreme court can overrule its own rulings.
4. Congress can rewrite a law to conform with Constitutional standards.
5. The Constitution can be amended. This would require a two-thirds vote of both houses of Congress, and ratification by three-quarters of the states (actually, at least 39).
If you think a law is unconstitutional then it can be challenged in the court. For example, there was an article in WSJ about some lawyers planning to challenge the health care bill once it becomes a law. One of the reasons: the health care law would require a person to buy health insurance, which infringes upon constitutionally guaranteed individual right of freedom. Now not to deflect from the topic of this thread, the bottomline is if you think the law is unconstitutional then you can challenge the law in the court.
The Key Point: Equal opportunity employement advancement is protected by Constitution ("Title VII of the Civil Rights Act of 1964 (Title VII)")and hence the Supreme Court can overturn the per country quota limitation if the Supreme Court finds that the per country quota leads to discrimination at employment, which is unconstitutional.
I agree with you.
Country limits is a law. A court has to follow the law. Court does not decide if the law is fair or unfair.
If you want to change the law, go to congress.
BUT SOME PEOPLE HAVE TOO MUCH MONEY TO THROW AWAY TO LAWYERS.
And whats with big lawyer names? Just because a lawyer has a website and writes on a website, does not mean he is a big lawyer. Look beyond the marketing of lawyers and see their skills, track record and genuine concern for your long wait. You are asking the same lawyers to help you whose bread and butter comes because you are applicants in a long line.
Highly educated innocents!

Hi,
How can one know if ones employer has withdrawn/cancelled ones H1B visa? Apart from asking the employer, if one uses the EAC # ans checks the status on www.uscis.gov, will it be reflected over there?
Q: Can an employer cancel H-1B visa without employees knowledge/consent?
A: Yes and remember it is illegal to travel on a cancelled visa.
Q: If an employer can cancel my visa without my knowledge, how do I know that my visa is still valid?
A: Unfortunately, the only reliable source for that information is INS and your employer. There is really no other way to find out. You could try INS although they may not help you as you are an employee.

First of all - THANK YOU. It's because of IV I am happy today with EAD cards on hand. I will never forget what IV did for me and thousands of GC applications in July. I can't forget the despair and the smiles IV brought back to our lives.
Probable reason - less motivated for couple of reasons which are already spelled out on this forum by others.
However I hoped to be part of rally towards the end. But couldn't. My parents came to USA last Friday. I did plan to combine my parents D.C tour with IV rally. But as such we happened to drop-in to D.C, unexpectedly, from Baltimore on Sunday itself. And on Tuesday 9/18 - all important day, we were busy packing to other attractions....
To Franklin -
Rally agenda - from the start, the D.C rally has not seemed need-based rally. San Jose rally and flower campaign were need-based. They were needed because USCIS ditched all July hopefuls. We were aghast and speech-less. So there was that burning-sensation in our tummies that took us to streets and greet the USCIS chief with bloody flowers!!
D.C rally has been strategic one. Somewhere in the beginning of the game, we pushed wrong buttons in marketing/selling the strategy or signing up people for the D.C rally. I remember very very few messages on the rally forums and tons and 100s of messages on "July 2" forum.
All senior fellows and the 1000+ members who made it to rally - have you surprised why there is NO 5000 - 10000 attendance.
Some more pointers to my thoughts -
> I can't associate all IV handles with real people easily.
> I don't know who is what (like in organizations we have people associated with certain responsibilities).
> Has anyone ever asked whether we should mention our association with IV in 485 application? And the repercussions?

Just to clarify. You say that "a person with an MBA plus a 4 year bachelors from a US univ. will be exempt" but you don't really need the 4 year bachelors from a US university. The MBA from a U.S. university is enough to be exempt, even if your bachelor degree is from outside the U.S.
You are right. I typed it wrong. I really meant to say "4 years of bachelors from anywhere (which is equivalent to a US bachelors degree)". I was making the point about four years because some non-us bachelors degrees are 3 years, and they do not accept 3 years + masters as equivalent to US bachelors + masters as the number of years of schooling would be one year less.

Hi,
Did u find a reply for this? What did u do? I have the same situation..
Please show some lights..

Im working for company A and company B has sponsored my GC as future employee and also did a H1 transfer from A but got a big RFE. Now company C is ready to do H1 transfer. Is it a good idea to do so or would get into problems as GC is in process through B? We did I-140 & I-485 concurrent filing and got our EADs approved but I-140 is still in pending status. I heard that using EAD is not a good idea when I-140 is pending.
My Attorney is sending a response to RFE but Im not sure whether it gets approved or not. What happens if B transfer gets approved and would choose to work with B and not use C at all (if it gets approved)?
In the other way, If C gets approved and choose to work with them as the H1 with A expires pretty soon (got to move out) can I comeback to B with a fresh (another) H1 transfer. Please suggest what is the best to do at this time?

I've read the document. IEEE is supporting "Immigration Visas" but not H-1B visas(temporary).
Can you shed some light what they meant by "Immigration Visas"?
It would be great if you can give us an example of some one coming on "Immigration Visa" and becoming a permanent resident and subsequently a US citizen.
Immigration visas are really GCs themselves. The only ones that I know who come directly to US on one are the family sponsored immigrants.
i agree IEEE is right about H1-B visas denying rights to workers (we dont claim it is perfect either). But it is just not conceivable for EB immigrants to come directly on a GC, given the long delays. So what they say sounds valid in theory, but impossible in practise.
If USCIS takes 5 years to process an EB visa, how is anyone going to wait that long to hire a foreign worker ? And what is going to happen to a foreign student when he graduates ? go back home and return after 5 years ? Even allowing for significant reform, and assuming their "instant GC" proposal is really instant, I dont see a GC ever being processed in under 2 years anytime in the near future. IEEE only provides lip service to legal immigration, while pushing its case against H1-B. I have not seen any concrete proposals from them to make the GC process painless. To me, it all smells of a veiled attempt to make the immigration process so cumbersome that few employers will want to even go for it.
IEEE-USA might at best be neutral towards our cause, but going by their reaction to CIR, I dont see them jumping with joy if GC numbers are increased.

To give a simple example, our company is looking for people in Australia, Denmark, Finland, Canada and UK since the pool of qualified people in India has dried up in our field.
Can anyone guess where is the biggest talent pool? Nope, not in Bangalore, its right here in USA!! Not all companies are looking for the cheapest person. They are looking for the best person. And in many cases, the best person is already here, and has gathered more experience over the years working for US companies.
But they cannot hire her, simply because she is on a visa and thereby beholden to another company. If she had a GC, that would free up the talent pool and thereby make many companies less reliant on H1Bs.
Increasing GCs for EB candidates has the same effect as increasing H1 quota, with the added benefit of making the cream of the crop available and reducing the uncertainty and hassle of hiring an H1.
Please blog the above at One Easy Fix For Immigration (http://www.businessweek.com/bwdaily/dnflash/content/jun2007/db20070620_915353.htm).
To all, please blog clear + strong argumennts (like above) at the above site and all similar sites.

Matthew OH is playing with words since yesterday. I am not even sure if he knows what he is talking about. Did you guys read the stuff about 485 filing. The phrase "Untangling the tangled mess" was mentioned 3-4 times. After reading his notices, one has to wonder what the heck is he talking about.
Well...he is working hard to get "14 million hits" on his website. 13 million is not really enough you see :)

People with EB3-India may not expect any kind of fast movement in near future, unless law changes. It will be in snail phase. It is waste discussion to analyze howmany people filled EB3 LC from India in 2002,2003 etc. Generally EB3 is very high demand catagory from all accross the world. EB3 contains skilled worker catagory including cooks, nurses, and so many many non-professional occupations. All the discusion are focussed on demand by Indian IT folks, by ignoring other spectrum of the demand by other group of peoples. Therfore no matter what; EB3-India will get only 3000 EB3 GC per year (Approxmatly 1500 primary).
1500 LC per year EB3 India is a tiny fraction of the demand by EB3 India. Therefore best advise in EB3 India folks to convert into EB2 to get use of early PD like 2002 or 2003.
Only when EB3 ROW becomes C can EB3 China, India & mexico see a leap in priority dates. March bulletin 08 pushed EB3 ROW by 2 years. Apr bulletin pushed it by another 6 months to Jul05. If demand for EB3 ROW is still low, then final quarter of this fiscal year (Jul to Sep), priority dates for India EB3 can possibly see a jump forward by 1-2 yrs.

Hello,
I have a few questions regarding the application for AP for a dependent, and I would appreciate it if someone would answer them.
1. If the dependent is applying for AP, should I include the primary applicant's I-485 in the application packet?
2. The dependent has an EAD. Is it necessary to include copy(ies) of the EADs with the AP packet?
3. If the previous AP has expired, is the applicationo process for a new AP different from that if a non-expired AP is being renewed?
4. I was reading in some threads that the $305 fee will be waived if there is a pending I-485. Is that correct?
Thanks in advance!
