Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?
Is it possible to file I-485 again (with older PD) after switching to new employer? Does AC21 rule allow this?

Kudos to the MI chapter for their first chapter meet.
I am sure it will act as a great motivating factor for the other chapters also.
Lets keep the good work going on.

BharatPremi -- On what basis are you saying that? There are 1000s and 1000s of L1 VISA holder from India....there are at least 30,000 H1-B that come from India every year, most of them file under EB-3 category and then have wives and kids and they consume visa number.
I think EB-3 India will never move forward. I would love to know the reason behind what you just said about EB-3
It is a long story and has already been discussed here at great length. Whne you get a time click on my past postings and you will get the tons of info which relates to this claim.

If we don't receive a notification today saying that our EAD has been approved, does that mean that we would get a 2-Year EAD card? Or do you think that they will work over the weekend? :D
Unfortunately, sometimes they work on weekends :D

Good News indeed, but to be frank it just doesnt excite me even a bit. After being stuck for over five years and getting nothing at the end, I reserve the right for myself to be skeptical and pessimistic!! :-( --Sorry
There are certainly anti-immigration groups like IEEE/US and others who will use every weapon at their disposal to sabotage legislations like SKIL BILL etc., but the reality is that US economy is increasingly becoming dependent on foreign-born skilled workers and by gradual exit of baby-boom generation out of economy this trend will accelerate.
I hope Congressman Senssenbrener doesnt dismiss the legislation. It is just unfair to link the immigration issues of Merit-Based Immigration Applicants to border security.
Please let us know what we could do to help the process.
Regards,

Did you apply in EB-1? If not, then .....
I don't want to scare you, but this could be pose problems for you down the line. Check Murthy bulletin....Murthy explicitly asked USCIS to revoke this earlier decision of GC approval for a client whose PD was not current....a case very similar to yours...as they anticipated lots of issues down the line. The topic of the bulletin if i remember correctly is "when GC approval is not good news" or something.
This was a USCIS error and there's a high probability will be cought sooner or later, at which point USCIS will revoke their earlier decision.

I would definitely agree that even if CIR comes back it has lot of negative things for people who are comming legally like us. We need to think of a different strategy which does not require a legislation which brings lot of attention against us. I can personally say that I will atleast add 10 more members with recurring contributions in a short time. Right now I will double or triple by monthly recurring contributions. I do agree with the core members that we do need lot of money now to lobby. There are are communities which I don't want to say publicly - even though there are in small numbers they have laws passed in favour of them. It is very simple - we need the MONEY POWER

Does anyone know the process of how USCIS updates 485 application, once 140 gets approved after 485 is filed (considering one files 485 with 140 pending receipt)?
Do we have to do anything in order to update USCIS regarding 140/485 once 140 is approved?
Any help is appreciated
Thanks!

Wait for the denial notice and be prepared to file MTR. Once u file MTR USCIS should accept the 485 and will processed in the normal way

I am EB-3 ROW PD 2007 Aug. Reading all the Eb-3 I people's angry, I started to wonder what's gonna happen to the EB-3 ROW. Seems like if lots of Eb3-I change to EB2-I , They will probably eat up all the Spillover from Eb1, EB2 ROW from now on. That makes EB-3 ROW and EB-3 I become the same boat.
Is it what gonna happened? and think about how many people can afford to spend an extra 10k to change the status from EB-3 to EB-2? That's totally not fair. We need to take action all EB-3 ers!!!!!!
danny,
i do not think its' quite that bad for EB3 ROW. the spillover system now in use is what USCIS was already doing till 2005. only in 2006 did the vertical spillover have any impact, since 2007 numbers were skewed by July. so things really have not changed that much for EB3 ROW. they will still get the large bulk of EB3 GC numbers, while retrogressed nations are limited to 7%.
also i do not think every future filing can be EB2. as it is USCIS a DOL appear to have tightened their scrutiny and narrowed their interpretation for both EB1 and EB2 approvals.
you are right of course that we must do something that helps everyone. recapture asap and then getting GC numbers increased (whether an absolute increase or exemptions) is the only solution.
