Thanks to the glorious service of the Atlanta center :mad: I missed the I-485 bus by 7 days( Labor cleared on Aug end ). Many people with later PD's got cleared from the Chicago PERM center . Now I just watch as all members get their EAD's and AP's while I wait with nothing but hope and watch legislation after legislation fail in the senate and house , and the letters flying all over the place .

I am also working on a FHA (4.875%) with GMAC with 3.5% down.
Wife's H4 was an issue, but that got cleared
Now the last thing is they are asking for 3 yr Continous VISA from the date of closing.
How did U convince the Bank to accept the H1 +485 stage

I hear you and for most part agree with you that USCIS - However bad they may seem - is still one of the best run government agencies...
No need for you to trash another country to make your point... We are all foreigners here and know what happens in rest of the world...
Chill... and BTW - USCIS does not give you a green card for sucking up... as you said there is a system and a process in place in US our Karm bhoomi...

I don't know what nationality you are, but, I am an Australian and I don't need to suck up to get my green card. I will get my greencard soon, probably sooner than you.
In fact, there is a special immigration program "only for Australians" that allow me and my dependents to work and live in Australia indefinitely. That was signed in to law by the President last year, if you didn't know about that. I guess you got me wrong. Australia and America have good relationships as you know.
I still would stress to thank America for giving me the opportunity to work and live and experience America.

Yes I think so too. specially I am EB3 India Dec 06, who know I will be current next July-Aug-Sept. hopefully this is the last EAD renewal (valid Sept until 2012)

But again, the thing to know about this stimulus package/rebate is that this is not FREE money; it is merely an advance on your 2008 tax return. Remember that and think twice before you spend it foolishly. Better still, send it to IV, contribute to an IRA or fund your kid's 529 plan.
What you said is not right according to the following IRS FAQ:
Q. Will the payment I receive in 2008 reduce my 2008 refund or increase the amount I owe for 2008?
A. No, the stimulus payment will not reduce your refund or increase the amount you owe when you file your 2008 return.

I am hoping they just dont tie EB2 I and Eb2 C at 15th Feb 2005 in April 2009.
Previously we have seen bulletins where Eb2 I and Eb2 C have tied up at 1Apr2004.
I dont know how many iterations it will take before it reaches the RIR/PERM boundary(1 Apr 2005)

it does say that H1B ext beyond 6 years can not be granted if there is not underlying pending process for GC (LC, 140 or 485).
However it does not talk about 'what happens if an ext is already granted'? so it still remains gray area. did I understand correctly?

Everyone getting receipt notices, and not coming to the rally, (not coming to the rally -most on tracker threads), please at least consider contributing to the rally once you get your notice or FP done or get EAD!. The rally cost is huge and we can do much more if people can contribute generously.

EAD most likely doesn't get cancelled immediately. Find a post by 'lazycis' on this thread. Even if it gets, which is rare, one can still continue working on EAD. I know this sounds not right, but again search this thread. This is confirmed by few replies and ref links are provided to RG's website.
2. If I continue working while filling for MTR, will it be illegal?
again... look for links to RG's website for this. As per RG, this is considered as something 'beyong applicant's control' i.e. an applicant has nothing illegal, but CIS committed an error, so an applicant can not be punished for CIS error. My personal opinion is, it is always much safer if you have a good experienced immigration attorney on your side.
3. How much it costs to go thru' MTR process? How long it takes?
Most likely 60 - 90 days. Costs can vary, but it is not really really high.

Recently thru same employer I filed EB2 labor which got approved in Sept 2010. I have filed my I-140 under regular processing. I asked my attorney and he said as I already have one I-140 approved I should file this one under regular processing. USCIS might reject premium processing. Any advice.
My 6th year of H1-B is getting completed on Sept 2011.
Please suggest should I file my I-140 under premium processing? Should I try to convert it???

Do you know any employer or recruiting agency (in NY) who can help sponsoring physical therapists for 140 & 485.
I got a NY work permit and got my crdentials evaluated but unfortunately that emplyer is no longer having job vacancy. Now I am stuck and don't know if I can get benefit from some other employer.
Any input would be greatly helpful.

Assuming it takes longer than 12 months, what are the options here? I would like to understand what AC21 says. Is having an EAD a precondition of using the AC21 provision i.e. does it say -
"an employee after 6 months of filing 485 AND having an EAD in hand can switch jobs"
or does it say
"6 months after filing 485, the employee can switch"

I'm not saying a person on H1B necessarily should be allowed to apply for 485. All that I'm saying is the day when a person starts working on H, the PD becomes his/her's. Lets take an example.
1). A person start working on H1B from Apr'1998
2). In apr'2004 Employer "n" applies for Labor to permemently employ the alien. In that case the PD for the alien becomes ar'2004 correct?
3). instead I want th PD to be Apr'1998.
This gives the person the flexibility to move on to better prospects as a H1B, but at the same time preserves the PD. Ofcource the LC process needs to be restarted again each time he moves. Also one might choose to not file any LC because he does not plan to become a PR. Thats fine because nothing is lost.
What i meant was, although H1 it is a dual intent visa, you dont necessarily show your intention until you apply for your green card process. There are cities that follow different tax structures when you apply for labor or not. Technically, that when you are showing your intention of immigrating. So why throw a blanket on entry date on H1, when some of them dont have the intention of immigrating to US permanently. This will only increase the demand of the GCs.
