This is excellent news and we should step back and celebrate for a moment, however we need to concentrate on IV goals.

I am sure we will have to fight retrogression soon again and other issues, probably name check etc. Please continue contributions to IV...

    GO IV..

If you read my post carefully, I am suggesting this 'in addition' to what's already on IV's agenda. Why can't we work on this item in conjunction to what's already being worked on? I have started preparing a fraud list from a bunch of websites like desicrunch.com. I noticed that almost 90% of firms reported there are fraud firms and it makes me wonder about the efficiency of local authorities. Also I don't see how targeting blood sucking desi firms would feed the anti-immigrant trolls. I would think we Indians would benefit the most since it would increase our credibility in general. Thanks for considering this idea at least. I would like to know other people's thoughts based on my clarification here. This drive might clean up cases freeing up visa numbers for genuine EB cases from India. Why should I be in line with crooks ahead of me? It doesn't make sense whatsoever.

And yes, my contribution to IV so far as been $1000 and involvement in other drives. Your question to me regarding my contribution made me squirm a bit since you might have categorized me with many of IV's freeloaders. That's just like Americans asking me all the time "Are you on an H1-B visa and do you work for a bodyshopper". :)
But I will work on making new contributions as well.

    Contribution so far: $1000

Sc3 and other friends. Here is what has triggered this bad blood on the forum

Apr VB EB2 is U and EB3 is doing well every one is normal exactly like every other VB no surge of threads and replies everything is normal

July VB Eb2 is in Apr 2004 and Eb3 is in U again every thing is normal

Aug VB Now suddenly Eb2 is 2006 and Eb3 is U ( no change) and all of a sudden there is a flood of e-mails complaining injustice against EB3. I think the timing of when Eb3 folks realized injuistice is what ticked off many.

I am not saying every one shares this feeling but just the sheer volumes of posting on this thread speaks for itself. I am sure many do not agree with me (or least pretent not to agree) Any one can query Eb3 injuistice posting before Aug VB and compare it since this bulletin was posted and see the data speaks for itself we do not need any body to prove anything

In fact looking at statistics posted by sachug22 here (http://immigrationvoice.org/forum/showpost.php?p=265004&postcount=20), it looks like it is EB2 that got shafted all along and finally DOS/USCIS realized their folly and tried to correct the spillover rule starting this april (as explained in July'08 bulletin). This re-interpretation does not affect EB3-I negatively. I do not know why so many are getting riled up over EB2 progress.

Like I said before, you still need to learn how to use your head first. I never learnt how to argue with the stupid and no one can.

    Singhsha,
    Please see the below.

    Employment-based preferences 162,176
    First: Priority workers 26,697
Second: advanced degrees or aliens of exceptional ability 44,162
Third: Skilled workers, professionals, and needed unskilled workers 85,030

    http://www.dhs.gov/xlibrary/assets/statistics/yearbook/2007/table07d.xls

So from now on in EB2 there would be around 100k approvals where as in EB3 it would be around 50k approvals due to the chage of vertical fall out to horizontal fall out of visa numbers.

I agree with concept of sending ac21 letter but there are similar experiences that this letter is ofcourse of hardly any consideration.

AC21 is a law, if erraneously denied it should be opened by MTR...as ppl have underlined , it doesnt matter whether a person used EAD or H1B. This whole discussion is triggered by employer revoking 140 not becoz USCIS is denying due to I129. Its all in the IO if hez not aware of AC21 thats our trouble begines. :( but i have not heard of any failure of AC21 MTR so far ...

prince_charming, you had mentioned that you had done H1 transfer with AC21.
I think it was mentioned in one of the posts in Murthy site that such a situation could lead to denial of I-485 as it would constitute abandonment of AOS application. One should use EAD after filling AC21.

So you again ignited the thread once again that it had died. You have only two posts and that too only on this thread. That only shows that your only objective is to start infighting.

I am in a lot of stress. Please help out if possible.

Six years on my H1B expire in April 2008. I just got laid off from company A. My last day of work will be May 31st. I have LC and I-140 approved with company A.

If I join company B starting June, and transfer my H1B to B, can it extend my H1B beyond 6 years based on the approved I-140 I had with company A? If yes, will it be for one year or three years?

Gurus please help. I will be grateful.

    Thanks

Don't worry..you still have time..start hunting for a job and you can transfer and extend your H1b for 3 years based on I-140 approval(beyond 6 years).

My posts at IV is to help IV and its members to be on the virtual vigil and to achieve IVs stated goals. I firmly beleive my threads and posts generally have a very positive comments from real IV members.

It is clearly members like chiecoli (http://www.nclex-rn.net/nclex/messages2006a/132169.html) that are really upset.

Short of substance and material. Let me know if I can be of help from my skills, research and ability.

It seems nurses are more frustrated because their H1B visas are getting rejected by the tons over there at Philipines. Read straight from the source. (http://www.filipinonurses2us.com/2007/02/denying_h1b_app.html)

I am not going to take anything by staying quiet. Give me your next salvo. I am ready with more research.

    DEAR ALL,
I was invited to post directly to the President-elect on his site change-gov and you can see my post here...
    http://citizensbriefingbook.change.g...Pos=0&srKp=087

I request you publicize this as much as possible through your FORUM and ask them to VOTE UP on this issue on the Presidents site so that this is taken as a charter and presented to the President.

The complete text of the article under the TITLE: IMMIGRATION REFORM ALLOWING H4 VISA SPOUSE TO WORK is posted below for your immediate reference:

"The time to fix our broken immigration system is now We need stronger enforcement on the border and at the workplace But for reform to work, we also must respond to what pulls people to America Where we can reunite families, we should. Where we can bring in more foreign-born workers with the skills our economy needs, we should." -- Barack Obama, Statement on U.S. Senate Floor, May 23, 2007

Well said Sir, and now as President-elect, we hope to see some action on above.

This issue I bring to your attention may seem trivial, but throws light on darker side of the life of dependent H4 visa holders, who are mostly women. And since you endorse women empowerment, I believe you will give a serious look at this idea.

Theres a strong lobby support for increasing H-1B visa cap to address the shortage of skilled workers. Theres also a strong lobby opposing it. This idea will satisfy both the lobbies. A very simple way to literally double the number of already available skilled workers in the USA without having to increase the visa cap. Allow me to explain....

Currently the spouse of H-1B holders, the H4 visa holders are not allowed to work. Most of these H4 Visa holders are qualified, skilled and experienced. In one stroke of the pen, by amending this tiny rule allowing H4 visa holders to work, you will facilitate thousands, if not millions of already legal & available skilled workers in the US, to work. Please note that spouse on L2 Spouse/Dependent visas for L1 visa holders (intra company transferee's), ARE allowed to work through an amendment in 2001. And this can be used as a precedent. Even J and E Visa spouses (J2, E2) are allowed to work.

Good For the Economy: While its now a norm to have a dual-income family where the husband and wife both work, its become all the more necessary for a family to just survive through these unprecedented economic times. H1-B visa workers typically stay on for at least 3 years continuously if not extend it for the next available 3 years. All this while, the poor H1B and his family have to get along with just one income. Moreover, the law also forces the skilled and experienced spouse on H4 to idle at home. This I believe is a loss of national productivity. Your statistics will prove how many H-4's are currently idling away in the US.

Good for the Community & Social standing of Women:
To keep the family together, H1 visa holders bring in their spouse on H4 visa. And then, they get locked in the house. Ninety percent of H4 visa holders are women. Women being, more susceptible to domestic violence by the partner, becomes even more prone to violence due to her complete dependence on the spouse. They become prisoners in USA due to spousal abuse and immigration policies that give their husbands complete control over their lives. Yes, the immigration system is broken. The immigrant women get protection under VAWA but non-immigrants are not covered. Even if a law to let the non-immigrant battered women to obtain work permit is introduced, it might not protect women whose cases are dismissed as non-critical. The abuser can further exert his control over the victim and convince her that he has changed so that the victim might not press charges. Thus the abuser gets encouraged to continue violence. Divorce is not an option because most non-immigrants come from third world countries where a divorced women has to bear the social stigma of divorce and will not be protected in her own home country. Because of the long queues for Labor certification application and retrogression of visa numbers, getting an EAD and Green Card takes longer.

    Way Forward:

You plan to legalize people living illegally in USA (and working illegally), you plan to give them a low skilled requirement job visa, similar to the H-1B or L-1, only that skills required are low, and you will let their spouses work too. This will mean that the only resident visa holder NOT AUTHORIZED TO WORK will be the H-4 visa holders.

As a tech-savvy President, you may also want to browse this issue on Google groups and hear the voices of depressed, frustrated and more often abused women, here... Oops. I am unable to provide you the link as it appears to violate the change.gov comment policy (?). The group title is misc.immigration.usa and title is Why USA should issue the dependant visa holders work-authorization? Theres another forum under immigrationvoice.org you may wish to look up. Thanks.

When people who have come to the US illegally will be able to work legally the poor H4 souls (mostly skilled women) who have come legally and followed all the rules should be given a fair chance to contribute to the economy and better their quality of life. By a simple amendment, allowing the H4 visa holders to work, you will make a brilliant move, without upsetting those who oppose the move to INCREASE the current H1B cap. Please think about it. May God Bless America!

    Guys and Gals,
Lets not bash anyone here. IEEE might sound anti-immigrant on the surface in true sense, its only anti H1B for all the right reason. I am not trying to defend IEEE but just getting the facts straight. Please check the attached file which is a letter sent by IEEE-USA president to Gov of Minnasota.
    Raj

IEEE-USA has maintained a consistent position against H1-B visas for a long time. Of late they have been found making statements that cast aspersions on legal immigrants as well. I have often found that people who confess to hate only one type of immigrants are just attempting to air a politically correct view of their anti-immigrant philosophy.

    http://www.ieeeusa.org/communications/releases/2006/052506pr.asp

"Combined with the H-1B visa increases, the Senate bill also includes substantial increases in legal permanent immigrant admissions that could have a major impact on the U.S. information technology workforce and engineering enterprise, according to IEEE-USA.

Dr. Wyndrum added: "The bill opens the spigot on numerous skilled visa categories. The question is how many high-tech workers can the United States absorb annually without driving up unemployment and driving down wages? The Senate demonstrated its concern about the number of unskilled workers it would allow into our country; it should show the same concern for skilled employees."

I am not indian, I am chinese, and I attended the rally in DC. I am so touched by you brave indian people. while I feel such a shame that we only had much less chinese there. part of the reason is that IV is originally indian club. we got the message but kind of lack the close organization.

anyway, I am also thinking about another rally.

1, it has to be on weekends, so everyone can come

    2. it should be in multiple cities, from coast to coast, all major cities.
DC. NYC, chicago, LA, SF, houston, boston. reserach triangle, seattle etc, where professional immigrants lives most.

    3. we need to make sure everyone will come, need good personal organization, not just voluntarily, we need personal contact, conversation, meetings ahead, level by level, to build a good "relationship" with each other.
yes, this is the hard part.

    4. we really need to study the illegal immigrant rally last time, how successful they were !!!!

    5. honestly, we didn't get much media coverage. shame ! nothing on TV, newspaper frontpage. but--- if we have a huge rally, everyone will have to cover us, pay attention to us. it all depends on us.

    Love you guys

    we should hurry up

How can you say there is no stress for the person working at home, raising the family?

The poor H1 soul is constantly over-stressed as he is supporting a spouse and a child or even two children.

Imagine how the H4 spouse feels...he/she cannot do a thing to alleviate frustrations of his loved ones as her hands are tied..
I deeply care for my husband and I had lived through some agonizing days in the past when he was out of work, without salary etc..knowing how much he is in pain himself as everyone and everything depends on him, literaly....

We will be moving away soon 'cause we care too much for each other's happines to continue to live in the circumstances where we only suffer ...
I second you on that. But we must keep in mind,we know the law before coming here .Every immigration lawyer wants H4 law to be changed but, you know "USCIS".. they have handsfulll.

    Hi,
I have worked with these lawyers. I had the best experience. They were always on top of everything.
    www.gowda.com
    :)
    Guys,

Wanted to started this thread to get reviews on different law firms
I can understand the quality and committment of lawyers can make a huge difference especially in this unprecendented situation where all EB categories are made current now and now there is a rumour that it would be retrogressed back probably sometime next week with a new visa bulletin.

A lot of lawyers who are really committed and sincere to their client's clause: Getting them Green Card, are working overnight and over the weekend also so that their client can file I-485 ASAP and on the other hand few law firms are acting as slackers and not even responding to their client's emails.

Anyway, I am interested in knowing everyone's experience ( good or bad ) with law-firms and their recommendation.

My Own Case:-> I work for a multibillion dollar telecom company and joined this company almost 15 mos ago with a promise that they would start my GC immediately. Till Now, they have not yet file my labor. Their lawfirm is Larrabee http://www.larrabee.com/ in sanDiego. I don't have much experience with them as my application is still in my company's internal queue but based on the basis of my little experience, I would certainly not recommend them

    Thanks

    DD

A good attorney should be able to get those who availed themselves of the AC21 opportunity free and clear in their green card journey. The law seems pretty clear on this to me.

This is clearly a big deal for much of the IV community, who are stuck in this process due to inadequate EB visas and inefficient immigration service center processing.

I believe this might end up needing a class action litigation (for violating AC21 law) and an immigration attorney could make a name for him/herself in the process of this case!

Witness Carl Shusterman's challenge of the USCIS's erroneous interpretation of physician NIW laws and his subsequent stature in the field.

If there are adequate numbers of you, which based on this thread there seem to be quite a few, then approaching a good lawyer to represent the group pro bono and getting this mess sorted out for good might be a consideration.

    Any thoughts?
We are discussing it here. Please participate.
