There are around 400 immigration litigation lawyers. If 10 members can volunteer and send this template it can be done. I am in between projects and I cannot devote any more time for this. If anybody takes control of this thread and contacting the lawyers I would be most happiest person. Pls don't tell me that there are no leaders in this group of 25,000 people who can do this miniscule task of contacting 400 lawyers and co-ordinating with them.

TEMPLATE LETTER
Sir/Madam,
We are a legal immigration association with more than 25,000 members in different visa statuses like H1-B etc. There is a per country quota which prevents any country from getting more than 9800 visas.
Visa Bulletin for February 2010 (http://www.travel.state.gov/visa/frvi/bulletin/bulletin_4611.html)
This effects permanent residency (both familty based and employment based)applicants from India, China, Mexico and Philippies only. For example an Indian engineer with a masters degree has to wait 7-8 years for his permanent residency while an engineer with a masters degree from Mauritius would get his green card immediately.
We would like to challenge this racist federal immigration law. We would greatly appreciate if your organisation can help us from doing so.
These are some of the facts from the basic legal research that I have done.

Immigration Voice did 138 lawmakers meetings (in House and Senate). They did the rally. They would consider IV as a organization that can help them PUSH for their legislation. Now we have a place at the negotiating table.
Amen. Out of sight, out of mind, as the pithy goes. Those lawmakers will have a recall now because of the in-person meetings.

:) i understand your point and agree a bit, but gandhi wasnt into programming, he would have been sucessful no matter where he went. He had a unique vision, personality etc. we are average people with school going kids (try asking a 10 year old to learn 2 new languages all of a sudden and pass that subject in class) trying to establish ourselves somewhere. i mean if we have to go back we will and we will adjust and succeed.
the only thing that holds us back is...do we want to give up after waiting so long (8yrs in my case) and once we leave, we have effectively lost our position in the GC line...sort of no turning back.
I am in my late 20's and am going to finish my 7th year next month...you decide how many feet of water I am in.. Meanwhile I totally understand your argument that the situation is the most frustrating for people who have been here the longest. I'd say sharpen you swimming skills and then it wouldn't matter how deep the water is or how tall you are....I's say stick with it and endure hardship if you value the end result (GC ofcourse). Even if you decide to go back...whatever your age/experience be...never forget its never too late..Gandhi was 46 years old when he returned to India from SA after spending 22 years there..Still wasn't too late for him to start a revolution now... or was it ?:)
May be you might also want to change your handle...GCby3000 doesn't sound that optimistic

of course they will accept them
and they will accept your 485 and AP and EAD...
as long as they can cash the checks.
the law has not changed, no one can presume what will happen
it's just that we are the fools in this, spending thousands of dollars without any choice in the matter, and then in one sweep all of it will be laid waste and we will be starting again...
what's more, for the indians among us, with the merit system, when with 90 points on board you will have no assurance of ever getting a green card.
what a alife :-) :-( yeah both, i can't decide!!

You are certainly entitled to your interpretation and Mr. Gotcher is entitled to his but I wouldn't go as far as calling it a ploy to increase more traffic. I am not sure if you are an attorney but he is and he certainly has more understanding of immigration law than most of us here. As with any law and immigration in particular, there is room left for interpretation and Mr. Gotcher is simply stating his point of view. You are more than welcome to disagree with him but I wouldn't call him greedy.
i dont think its a controversy. mr. Gotcher does not agree with the interpretation. Maybe its a way to generate some additional revenues for his firm by increased traffic to the blog and potentially a class action lawsuit on behalf of the ROW people.

if Obama wins:
+ its better for the world in general. The last thing we want is more of GWB policies destroying both America's economy, civil rights, and respect in the world.
- his best friend Durbin will again pick up the stick and start beating up on H1 sponsoring. EB will also get run over by the same bus.
- FB immigration will be put in preference over EB, we are screwed.
if McSame wins:
+ my taxes remain low
- CIR is back. 13 millions illegals will get in line. points based system for EB immigration and we are all screwed again.
- if McCain does not live through his presidency, the biggest country and economy in the world, with the largest number of nuclear weapons, the largest amount of military spending... the rome of our time, with nearly unlimited power and presence around teh world, will be run by a mayor of a small town. Rember her trying to get her brother-in-law police officer fired during her sisters divorce? And when the administrator refused her requests, he fired him? Remember how she emails people off-the-record from her Yahoo account? Remember how she CC's her husband on official emails? Do you want someone that stupid, who already abused whatever little powers a mayor and governor has, to be the commander-in-chief of the united states armed forces?
Either way immigration-wise we are screwed. I think for the sake of the rest of the world we must wish that this time McCain loses this election. He has made a very stupid VP choice.

It is one way to reduce the budget deficit, each of us will be burning away $700- every year per head for AP + EAD renewal with close to a million applicants go do the maths.
And AP/EAD renewal cannot start before 120 days so that time period every year for at least 3 years they are gonna laugh their guts out.
And we thought we achieved a big feat with the July fiasco ......

Does the SKILL bill help persons who have already completed their masters or will it also help those who are pursuing their MBA/MS? (i.e if SKILL is implemented)
Will a person with 2 yrs experience and a MS degree or a person with 6 yrs experience and currently working towards their MBA (part-time) be exempted from the visa numbers?

Just a question, why is everyone so happy that the CIR has Failed and more importantly why does everyone on here feel that if CIR is resurrected it will "haunt" us?
If CIR fails to go into "production" this year, is it not true that we have ZERO reform? I mean would it not be better to ride this wave and try and sneak our provisions into the mix rather than SIMPLY feeling happy that CIR is "dead"?
At this point (even after the PD movement), About 70% of us are still in the retrogression mess and will continue to be in that mess till SOME immigration reform passes. So the question then is: Should we not be trying and praying that CIR passes WITH our provisions (and i know how hard the core team is working and hence i am asking this question). I mean the core team has given an infinite amount of time and energy to this project. Would it not be easier to see a bill finally pass and try and get our provisions in this bill rather than killing this bill?
It is good that it got killed. The current state of the bill was not CIR, it is CIIR. Comprehensive illegal immigaration reform. It was not going tp do any help to legal immigrants but hardships.

Being bitter does not get us anywhere..
I agree with you as well. Though feeling disheartened certainly we should not name them all here on thread. And I am just making request to that group (not attended meeting - After RSVP OR even did not send RSVP). I know one member (never active visibly during any of meetings organized so far and/or never even active on texasiv board) somehow decided to call me (On my cell phone - plan with very less day time minutes) various times in past for having help for his immigration problems. I always helped him (And decided not to even ask him about his passiveness on texasiv board ). Now probably he might be thinking himself smart for using me but he does not have a clue that he is not cheating me or he is not cheating IV, he is cheating himself. That person is definately here for $ only and I am 100% sure he does not have a clue about the "history" of "immigration" and probably does not have a clue about "How and what USA is except $"... He certainly might not be aware about Japanese (Citizens) kicked out after pearl horbour... I pray that kind of time never comes in his life but if at all he may have to face that he would not survive for a moment with this attitude.
All in all what I am saying is we should not name anybody here who is passive and all passive ones should understand the seriousness of the problem what they are in and start being active.

I am one of many many and happy to see this development.
I am puzzled.
Just would like to remind you all , only couple of months back, there was a great optimizm of CIR .. but today we know it is in stalemate.
So I think this time around we should be cautious. I have a question... What is the gaurantee that this bill is not to increase H1-B alone? Sorry If I am not being optimistic here.
I request, Our web faxes clearly state why we support SKILL BILL... If I read right and remember it well, this Forums goal is to reduce retrogression/backlogs.
Now to be positive I am copying an extract that was in quotes in press release ..
“To our detriment, current policy mandates that we educate and train these brilliant individuals and then send them away to other countries to compete against us.”
Thank you IV for your efforts.

GCBy3000, your story is so similar to mine. It is a sad story. Let's look forward and win this battle. I think if we keep ourselves our education up to date we may succeed.
In 2005 I started the MBA from a top 20 school. When I reached 50% of it, I put the thing on hold because I realized that I could find employers in this area which could pay the $50,000 the program was costing me. The good news is that when I completed 24 credits, I got a part-time job on EAD as a lecturer for a bachelor science/300 level course in infosec. The bad news is that I learned in 2006 that my MBA in Information Systems has been discontinued and I lost all my credits and valuable $14,000 I spent.
Therefore my advice for those thinking of starting the masters program:
Go for it, start and finish it. If you are on EAD, apparently you should be eligibile for US Federal Aid Loans.
I am very happy teaching one night/week, that extra income is enough to pay 90% of the masters program (it is true that I am planning to resume the masters and pick MS Information Management instead, as that seems more strategical (and less expensive) than MBA to me.
I was thinking about PMI, CISA and MBA right from the time I landed in US in 1999. Then I realized that I need to get an GC to make use of those. Then I started to look for a stable company where I can start my GC process. It took three years toll till then. I joined a good ameican company as a perm employee. They did not file my GC as they promised and I had to quit to join another company for the heck of my GC and for my (my wife with CPA / CA is on H4 for 5th year now) dream career. I had to go many step back in technology with the new company but I sucessfully managed to file my GC.
Then what? When I finished studying my PMI, all the retrogression story started. Then I had to ask questions my self.
1. With PMI certification in 2004, if I am doing a Sr. Software engineer, will it not raise questions down the line in my career interviews. May be yes or no, but I do not have answers.
2. With PMI Cert in 2004, if I can get my GC in 2005, I am pretty sure I could manage any questions throws at me, but not in 2008 or 2010. So I dropped the idea on PMI / CISA/ GMAT until I have 50% certanity of when I will be getting my GC in hand.
3. The worst will be starting an MBA with good univeristy and competing it in next two years with zero hope of getting GC then. What would you do if you are not even closer to file your 485 when you have MBA degree in hand. You will have career in your home country with this MBA for sure, but who will pay your debts here. It is like shooting yourself on your foot with golden gun. Atleast you will be satsifed it is golden gun, but the end result is hurting yourselves.
4. So what is the option? Never give up. There are always difficult times for everyone. What we are facing is nothing. There are people who are graduating at the age of 70 in US. I have seen a lady at the age of 70 graduating with MAB from Harvard. I thought she did it for fun, but in an interview she said she wants to pursue her career in marketing field. This is an eye opener for me. So prepare yourself with TOEFL and GMAT. These scores are valid for 5 years. Join from volunteer organizations and develop your leadership skills. Reco letters from these orgs will have great impact when you apply for MBA infuture. Most of all it is right way to live a peaceful life atleast if you do not go the MBA route, you will develop the skills needed for your life.

I said I am not defending IEEE....so where the question of praising comes?
I've read the document. IEEE is supporting "Immigration Visas" but not H-1B visas(temporary).
Can you shed some light what they meant by "Immigration Visas"?
It would be great if you can give us an example of some one coming on "Immigration Visa" and becoming a permanent resident and subsequently a US citizen.
