I recently applied under 0213. I agree process is not as complicated as it sounds also I am not sure what value add a lawyer will do apart from keying information from you in the forms. Sorry that I could not reply sooner. In this case, I went ahead and did an Info Pass appointment. The officer there went ahead and gave a 1-year temporary stamp and said he was ordering card production. This was in July and I am still waiting. My lawyer said "congrats"! No idea how to handle this going forward. What happened to your case?

I got laid off with a pending I-140 filed July 2006 along with I-485. I was told that as soon as those docs are filed my H1B becomes invalid. True? I still have an approved H1B receipt from another company valid thru Feb 2008. Can I still use it? Thank you.

Everbody's posts here are speculations on what USCIS will do to I-485's filed on or after July 2. Everybody is trying to get an answer from USCIS. You called and got an answer DIRECTLY from USCIS which you doubt and don't believe. So what you want is for people here, who can only come up with speculations as to what USCIS's action would be, to confirm what USCIS already told you???

Reading through this, this only says that the status cannot be changed (to a PR). It does not say that the prefiling of of AOS application cannot be done.
I think we should definitely try to work towards this. There was also an article on Immigration daily (http://www.ilw.com/articles/2009,0225-endelman.shtm) which suggests pre filing as a administrative fix that will solve a lot of problems. It argues that "there is nothing in the INA that compels a particular definition or understanding of what "immediate availability" means."
I am definitely in for such a initiative.

I also think that the NSC Service Center update issued on November 20th, 2006 is not still valid. ( To file 485 without i 140 receipt notice)
Actually NSC was very slow in processing receipt notices during that time and hence the update was issued.
But now, the maximum time to send out a receipt notice is 15 days. So I am not sure if we can rely on that update.

This is a different employer, so I am assuming it is new H1. If I remember correctly from my past research, H1 is always NEW when you file it with different employer, but I am not 100% sure....

It is New H1 with Transfer of I-94. It has been shortened into H1 Transfer to separate it from 65000 per year Quota.
If someone gets the H1 approval without I-94 they call it H1 is approved but transfer denied. They will have go out of the country and come back to get I-94.
When someone doing the Transfer they put it as new H1. Then they will say whether it is coming from yearly quota or not.

I appreciate the efforts of core IV and have held them in high esteem. As I said in my post, I read all the posts / replies that I am connected to with sincerity of purpose.
Yet, I don't see a response to set up this web fax. We need to write and counter this grab of unused visas.

As long as you have had a valid h1b peition approved for employer 1 and employer 2 while you worked for them you are FINE.
According to my lawyer there is nuthing like a h1b transfer. When someone decides to move to a new sponsor that new sponsor files for a h1b via the petition but nuthing gets transfered, they need to refer to old h1b just to prove thatyou are legal and have been maintaining legal status.
in your case Employer X did so but you never joined that employer so you are fine. USCIS can get back to that emplyer if they have not cancelled your h1b as they are liable to pay you by law.
For real as you had an approved petition (latest but not the greatest) from Employer X but did not join them you are fine as long as you were still holding a valid petition with Emp # 2. You should respond back to RFE stating that you were maintaining stauts via emp#2 and were offered a job by EmpX which you never accepted. As a proof you should sen copies of pay stub for enitre period and w-2 + peition and visa copies.

I think for Indian EB-3s, if your priority date is after March 2002, it is definitely worthwhile to do the conversion. Chinese EB-3s with priority dates after Sept. 2003 should definitely convert too.
Even considering the time to find a job, file a new labor and I-140, it still looks like that you will get your GC faster than waiting in a not-moving line. The recent history has shown that the visa bulletin can get stuck for a specfic cutoff date for half a year. Besides, EB3s have been and will always be of a lower priority just as someone said in other posts.

So in this case if I work for EMP A and apply for a h1b thru EMP B as soon as the MEP B's petition is approved I lose the approved peition with EMP A ??? I know the answer but want to see your take....... (No. as your scenario is quote, Emp B applied for a H1B (assume new filing). Emp A H1B is also valid as long as one of them is your primary sponsor with full time job. If Emp B transfers an approved H1B for Emp A, then Emp A as a sponsor cease to exist. Emp B becomes the new sponsor. Hence any work done for Emp A will be unauthorized.)

It sucks! I just the card production ordered email this morning! Filed May 29th. Receipt date May 30. No LUDs until this morning and card production ordered today. What a waste of money... This is my wife's and still small hope that they won't approve mine until monday...
